A DEVELOPER is facing court after Colchester Council launched legal action over a breach of working and delivery hours. 

Colchester Council served Dandara with an enforcement notice in May after it breached planning conditions at its site in Hall Road, Copford. 

The developer is building 50 new homes. 

Residents had raised concerns about safety at the site and the hours deliveries were taking place sparking an investigation by the council.

A spokesman from Colchester Council said that it had investigated breaches related to hours of work and delivery times.

It said it had brought these to the developer’s attention and a Breach Condition Notice (BCN) was issued on June 19.

The spokesman said it invoked legal proceedings after a site visit on June 20 where enforcement officers attended.

The spokesman said: "We are aware that residents still have concerns and would encourage them to report any breaches that occur on site (outside of those that the BCN was issued for) to us.

“These will be investigated and, if found to be in breach, the appropriate action will be taken.”

The spokesman added: "The length of time proceedings will take is dependent on many factors, including the outcome of an initial plea hearing, and will be determined by the legal system and processes that need to be followed.”

A representative from Dandara said: “We have not been served with any legal proceedings from Colchester Council.

“All our large vehicles are fully banked both in and out of the site. However, we cannot be responsible for other users of Hall Road. We encourage those with concerns to please get in touch with us directly.”
