THE family of a woman who was run over in a Waitrose car park will have to wait another six weeks before a decision is made on whether the accused will stand trial.

Colin Kirby-Green is charged with causing the death of Patricia Jepson by dangerous driving last August, but has not appeared in court because of ill health.

The defendant was first due to attend Colchester Magistrates’ Court in April, and further hearings at Ipswich Crown Court in July and August.

Those hearings were adjourned because Kirby-Green was said to be suffering “neurological consequences” from sepsis.

A note from the family of Mrs Jepson was handed to Judge Martyn Levett on Friday, when he asked for psychiatrists to attend a court hearing to explain Kirby-Green's fitness to attend court.

He said: “Two psychiatrists could appear via video link and I could take advice from them.

“It is my practice to hear why someone says they are not fit [to stand trial].

“I am trying to help the family by saying this – the judge has a toolbox available if he felt the defendant standing trial would be desirable.”

He continued: “Because of the note I have received [from the family of the deceased], I will insist [on psychiatrists attending].

“I could always summon them.”

When it was suggested by Steven Dyble, defending, it would be a “draconian” move, the judge replied: “I think sometimes you have to concern yourself more with the victims of crime.”

The case will be heard again on Friday, November 8.
