No appeal will be made by Maldon District Council after it was found guilty of breaching health and safety rules.
The council faced prosecution from the Health and Safety Executive in Chelmsford Crown Court last month, where it was found to have broken safety rules after the death of a man in the Maldon's Marine Lake.
Father-of-two Kevin Gay died after hitting his head on a submerged post in the lake two years ago. The council was fined £75,000 and ordered to pay legal costs of £125,000 within five years.
At a full council meeting, councillors discussed Judge Hawkesworth's sentencing remarks about the case behind closed doors after members of the press and public were excluded.
After the meeting, Bob Boyce, leader of Maldon District Council, said: "All members of the council have expressed their frustration at not being able to discuss the details of the prosecution case in open session due to the on-going civil claim by Mrs Gay."
The council has now confirmed it will not appeal against either the conviction or the fine.
