A developer is to appeal against the refusal of its plans to use land in Heybridge to build 124 homes - after its previous rejection was quashed.
Thomas Bates and Son wants to build the development in Hall Road but has had its application turned down on a number of occasions.
However, a decision by the planning inspectorate in July to back Maldon District Council's refusal of planning permission for the development of the chalet site in Hall Road and the adjoining area, The Lakes, was quashed by the High Court, meaning Thomas Bates and Son can appeal once again.
Peter Le Grys, planning officer at Maldon District Council, said: "The situation is now back to square one. The planning inspectorate is putting up a new public inquiry to hear the case again."
Thomas Bates and Son took the case to the High Court arguing the inspectorate had misjudged its reasoning, that it was inappropriate and unjust and the decision made was flawed.
The High Court agreed as it found the inspectorate to be at fault. Problems with the development arose due to flooding fears.
