A furious motorist is ready to have his day in court if a superstore giant fails to pay out the cash he claims he is owed.
Mark Berry, 22, was one of many drivers left in difficulties - and offered compensation - after a tanker driver at Safeway on Canvey, mistakenly unloaded petrol into diesel tanks and vice versa.

However, his father, Steven, 56, of Haron Close, Canvey, claimed the suggested £350 compensation would still leave Mark £100 out of pocket because he had tried to fix his car himself.
Now Steven has lodged a claim with the Southend small claims court and Safeway bosses have until July 7 to reply to the claim.
A spokeswoman for Safeway said: "We are aware of the situation which occurred in March and the compensation cases.
"Our claims handlers are dealing with any specific claims and will ensure that those affected receive fair treatment.
"This was an isolated incident."
