Liberal Democrat Gary Scott was today celebrating after winning a seat on Tendring Council.
Mr Scott won the by-election at Alresford, Thorrington and Frating by 66 votes.
There had been problems after more than 3,000 polling cards had not been sent out by mistake.
But after the Gazette told Consignia of the problem, it sent managers out to deliver the cards.
The seat became vacant after Labour councillor Margaret McGann resigned.
Mr Scott won the seat with 347 votes.
Second was Conservative Neil Stock with 281 and in third place was Terry Ripo for Labour with 160 votes.
The turnout was about 26 per cent.
Following the result, Tendring still has a hung council. There are now 20 Labour councillors, 17 Conservative, 11 Liberal Democrat and 11 Independent.
