Jim Magilton has requested a personal hearing at the FA after being hit with an misconduct rap.
The Ipswich Town midfielder was charged after the stormy play-off semi-final second leg against Bolton at Portman Road.
Magilton, 31, appeared to kick out at a Bolton player before taking his second spot-kick but escaped any punishment at the time from referee Barrie Knight.
The Northern Ireland international will be summoned to appear before FA chiefs before the beginning of the Premiership campaign.
They have wide-ranging powers and could elect to fine him, impose a suspension or sanction both penalties if he is found guilty.
Bolton are still in the dock after the fiery night at Portman Road which saw ten of their players booked and two sent-off as they slid to defeat.
Boss Sam Allardyce has also requested a personal hearing for himself, the club and the six players who are also facing midsconduct charges.
