A Tendring police officer who is being investigated over allegations of misconduct at a private party could end up in court.
Case papers regarding the incident have now been submitted to the Crown Prosecution Service.
An Essex Police spokesman said today it would be up to the Crown Prosecution Service as to what action would follow.
He said: "Consideration will now be made as to whether there should be a prosecution."
The officer - who has not been named - has not been suspended and is still on duty.
The incident involves allegations made following the party in Clacton before Christmas.
It was a private function which was attended by off-duty officers.
The investigation was carried out by Det Chief Insp Bob Seals.
Even if no criminal charges are brought, the officer could still face internal disciplinary proceedings.
