Bedsit killer Mark Rybialek, who was jailed for life for murdering a frail neighbour, is to appeal against his conviction.
Rybialek has given notice of appeal to the High Court. He is claiming witness evidence was unreliable. He also claims evidence was omitted which he says could clear his name.
Rybialek, 27, is currently serving his sentence in Chelmsford jail after being found guilty in September of the murder of Brian Lamb.
A jury at Chelmsford Crown Court heard Rybialek was caught red-handed next to the body of Mr Lamb.
Mr Lamb, 64, had been suffocated in his own bedclothes after being tied up.
The crown court heard Rybialek had put a pillow case over his head with holes for his eyes to avoid being seen by CCTV cameras at the seaside bedsits on Marine Parade East where they lived.
Rybialek had denied murder and said he was wearing the mask to frighten another resident. He said he had only gone into Mr Lamb's room as the door was open.
But the jury unanimously found him guilty.
Rybialek was also found guilty of stealing a bank card from Mr Lamb on Boxing Day last year.
