A LEGAL loophole which may have allowed an elderly driver to get behind the wheel and fatally wound a teenager has been raised in Parliament.
Colchester MP Bob Russell questioned Home Secretary Theresa May about the law after Cassie McCord, 16, was killed by an 87-year-old motorist who was set to have his licence revoked.
The Liberal Democrat MP asked what powers are open to the police to take immediate action to prevent elderly or infirm motorists from driving when their ability is called into question.
Officers applied to ban Colin Horsfall from the road after he crashed his car at Tesco petrol station in Highwoods.
But he was still allowed to drive on the day of the fatal crash because he had not received notice from the DVLA.
